SHIFT IT — TERMS OF USE

Welcome to Shift It (“Shift It”, “we”, “our”, “us”). These Terms of Use (“Terms”) apply to all visitors, users, account holders, buyers, sellers and any person interacting with our platform (collectively, “you”, “users”).

By accessing or using Shift It, you agree to comply with these Terms.
If you do not agree, you must stop using the platform immediately.

1. About Shift It

Shift It is an online classifieds platform for advertising, viewing, and enquiring about vehicles and related items.

Shift It:

  • Does not own any vehicles or items listed

  • Does not verify listings

  • Does not act as a dealer, broker, or agent

  • Does not participate in or guarantee transactions

  • Is not responsible for user-generated content

All sales are between users directly, and you use the platform at your own discretion and risk.

2. Eligibility

To use Shift It, you must:

  • Be at least 18 years old

  • Have legal capacity to enter into agreements

  • Not be banned under Irish or EU law

  • Provide accurate information when creating an account

We may suspend or terminate accounts that violate these rules.

3. Account Creation & Security

To access certain features, you must register an account.
You agree to:

  • Provide accurate, truthful information

  • Keep your credentials secure

  • Not create accounts on behalf of someone else without permission

  • Not share or sell your account

  • Notify us immediately of any security issues

Shift It reserves the right to:

  • Refuse account registration

  • Disable or suspend accounts

  • Request ID verification if required for safety

4. User Responsibilities

By using Shift It, you agree that:

  • You are fully responsible for your own actions

  • You will behave respectfully toward other users

  • You will comply with all applicable laws (Ireland/EU or your local laws)

  • You will not misuse the platform or attempt to circumvent its security

You must conduct your own due diligence when buying or selling.

Shift It is not liable for:

  • Fraud by other users

  • Misleading information

  • Transaction loss or disputes

  • Delivery issues or incomplete sales

  • Damages caused by user behaviour

5. User-Generated Content

This includes:

  • Listings

  • Images

  • Vehicle descriptions

  • Comments, messages, or communication

  • Any material you upload to Shift It

You confirm that:

  • You own the rights to your content

  • Your content is accurate and lawful

  • Your content does not violate copyrights, trademarks, or privacy laws

Shift It may:

  • Remove content without notice

  • Edit content to correct or improve formatting

  • Restrict content if harmful, illegal, or misleading

  • Store and display content as needed to operate the platform

You grant Shift It a non-exclusive, royalty-free, worldwide license to use your content for operating and promoting the Service.

6. Listings Rules

When posting a listing, you agree:

  • You have the legal right to sell the item

  • All information must be truthful and accurate

  • You will disclose faults, finance owed, write-offs, or legal issues

  • Photos must be genuine and taken by you

  • You will remove or update listings promptly

Prohibited Listings

You may NOT list:

  • Stolen vehicles

  • Vehicles with fake, cloned, or hidden VINs

  • Unsafe or unroadworthy vehicles without proper disclosure

  • Illegal or restricted items

  • Pornography or explicit content

  • Weapons or controlled substances

  • Advertisements that redirect users elsewhere

Shift It may remove any listing at its discretion.

7. Prohibited Activities

Users must NOT:

  • Use Shift It for fraud or scams

  • Post misleading or inaccurate listings

  • Harass or threaten other users

  • Upload viruses, malware, or harmful code

  • Scrape or copy site data without permission

  • Attempt to hack or disrupt the platform

  • Create multiple accounts to avoid restrictions

  • Misuse messaging for spam, promotions, or abuse

  • Buy or sell accounts

Violations may result in account suspension or legal action.

8. Contact & Messaging Features

Shift It may include messaging features or integrate tools such as BuddyPress for communication.

Users must NOT use messaging to:

  • Harass, threaten, or insult others

  • Send unsolicited spam

  • Promote external services without permission

  • Attempt scams or fraud

  • Share illegal content

Shift It does not routinely monitor messages but may review content for safety, fraud, or legal compliance.

9. Third-Party Services

Shift It may integrate:

  • Payment gateways (future)

  • Identity verification tools (future)

  • Social networking or messaging systems

  • Ad networks and analytics tools

Each provider has its own terms and policies.
Shift It is not responsible for their actions.

10. Platform Availability

Shift It does not guarantee:

  • Continuous or uninterrupted access

  • Zero-error functionality

  • Permanent availability of features

We may modify or discontinue services at any time.

11. Intellectual Property

Shift It owns all:

  • Branding

  • Logos

  • Platform design

  • Interface elements

  • Software code

  • Text and graphics created by Shift It

Users may NOT:

  • Copy, reproduce, or distribute platform materials

  • Reverse engineer or exploit the website

  • Use Shift It trademarks without permission

12. Liability Disclaimer

To the fullest extent permitted under Irish and EU law:

Shift It is not liable for:

  • Loss of money or profits

  • Vehicle issues or disputes

  • Fraud or misrepresentation by users

  • Damages arising from listing or purchasing decisions

  • Errors or downtime on the website

  • Loss of data or unauthorized access

  • Any indirect or consequential damages

Your use of Shift It is entirely at your own risk.

13. Indemnification

You agree to indemnify and hold harmless Shift It from any claims, damages, losses, or expenses arising from:

  • Your use of the Service

  • Your content or listings

  • Your interactions with other users

  • Your violation of these Terms

14. Suspension or Termination

Shift It may suspend or terminate any account for:

  • Fraud or suspected fraud

  • Abuse or harassment

  • Illegal activity

  • Posting prohibited content

  • Multiple violations of these Terms

  • Safety or legal concerns

Termination is at Shift It’s full discretion.

15. Governing Law

These Terms are governed by:

  • Irish Law

  • Applicable EU regulations, including GDPR

Any legal disputes must be resolved in the courts of Ireland.

Updates will apply immediately once published.
