SHIFT IT — TERMS & CONDITIONS

Welcome to Shift It (“we”, “our”, “us”). These Terms & Conditions (“Terms”) govern your access to and use of the Shift It website, services, features, listings, accounts and any related platforms we operate (collectively, the “Service”).

By creating an account, browsing, listing, contacting other users, or otherwise using Shift It, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

Shift It is operated from Ireland and is accessible worldwide. Users outside Ireland are responsible for ensuring their own legal compliance.

1. Who We Are

Shift It is an online classifieds platform that allows users to list, buy, sell, or enquire about vehicles and vehicle-related items.
Shift It is not yet a registered company. For now, these Terms apply to Shift It as an online platform operated by an individual/sole operator until formal company registration is completed.

2. Eligibility

To use Shift It you must:

  • Be at least 18 years old

  • Create an account with accurate information

  • Be legally capable of entering into binding agreements

  • Not be prohibited from using online services under Irish or EU law

Shift It does not verify the identity of users unless additional verification services are introduced.

3. Accounts

When you create an account:

  • You agree to provide accurate and truthful information

  • You are responsible for all activity under your account

  • You must keep your login details secure

  • You must not share or sell your account

  • You must notify us immediately of unauthorised access

Shift It reserves the right to:

  • Suspend or terminate accounts

  • Request identity verification (such as ID or phone validation)

  • Remove users for fraud, abuse, or Terms violations

4. Service Description

Shift It is a classifieds platform, not a dealership, broker, or mediator.

We do not:

  • own or inspect vehicles

  • guarantee listings or prices

  • verify seller claims

  • participate in transactions

  • offer warranties of any kind

All transactions are strictly between buyers and sellers.

5. Listings

Users may post listings for vehicles and related items. By posting a listing, you confirm:

  • You legally own the item OR have full permission to sell it

  • All information is accurate and not misleading

  • Photos are genuine and owned by you

  • You will update or remove listings when sold

  • You comply with Irish law and any applicable international laws

Prohibited Listings Include:

  • Stolen vehicles

  • Vehicles with altered, fake or cloned VINs

  • Pornographic content

  • Weapons, drugs, illegal goods

  • Misleading, fraudulent or deceptive listings

  • Anything that violates Irish law

Shift It may remove or suspend listings without notice.

6. User Responsibilities

All users agree not to:

  • Harass or abuse other users

  • Post false, misleading or defamatory content

  • Circumvent messaging or contact systems

  • Attempt to scrape, hack, copy or reverse-engineer the website

  • Spam or engage in mass messaging

  • Collect information from other users without consent

7. Messaging & Communication

Shift It may include internal messaging or communication tools (including future BuddyPress integration).

Users must NOT use messaging to:

  • Harass or threaten others

  • Send spam or promotions

  • Attempt fraud or scams

  • Circumvent safety or reporting systems

Shift It does not monitor all messages, but reserves the right to review content when a legal or safety issue is reported.

8. Third-Party Services & Add-ons

Shift It may integrate external services such as:

  • Payment processors (e.g., Stripe, PayPal)

  • Social or messaging integrations (BuddyPress)

  • Advert tracking (Future advertising features)

Each provider has its own policies, which users must also accept.

9. Payments & Fees (Future Feature)

If paid listings or premium features are launched later:

  • Prices will be displayed at checkout

  • Payment processors handle all financial data

  • Shift It will not store card or banking information

  • Paid listings or premium services may be non-refundable unless legally required

Shift It may update prices or introduce subscription options at any time.

10. Reporting Users or Listings

You may report a listing or user for:

  • Fraud

  • Illegal activity

  • Abusive behaviour

  • Misleading or inaccurate listings

Shift It will investigate reports but makes no guarantee of outcome.

11. Content Rights

By posting content on Shift It, you grant us a non-exclusive, royalty-free, worldwide license to display, share and store that content for the purpose of providing the Service.

You must not upload copyrighted material which you do not own.

Shift It may store, remove or modify content for moderation, safety, or operational reasons.

12. Privacy & Cookies

Your use of Shift It is also governed by our:

  • Privacy Policy

  • Cookie Policy

These explain how your data is collected and processed under the GDPR and Irish data protection law.

13. Disclaimers

Shift It provides the platform “as is”, without warranties of any kind.

We do not guarantee:

  • Accuracy of listings

  • Safety of transactions

  • Quality or legality of vehicles

  • Identity of users

  • Availability or uninterrupted service

You use Shift It at your own risk.

Shift It is not responsible for:

  • Fraud by other users

  • Fake listings

  • Financial loss

  • Misrepresentation by sellers

  • Damages from buying or selling items

  • Any transaction outcomes

14. Limitation of Liability

To the maximum extent permitted by Irish and EU law:

Shift It is not liable for:

  • Any indirect, incidental, special or consequential damages

  • Loss of profits, data, or reputation

  • Disputes between buyers and sellers

  • Issues arising from external service providers

Shift It’s total liability, if any, shall never exceed:
€50 or the total amount you paid to Shift It in the previous 12 months (whichever is lower).

15. Indemnity

You agree to indemnify and hold harmless Shift It from any claims, losses or damages arising from:

  • Your use of the Service

  • Your listings or content

  • Your breach of these Terms

  • Your dealings with other users

16. Account Suspension & Termination

Shift It may suspend or terminate accounts for:

  • Violations of these Terms

  • Fraud or suspected fraud

  • Abuse, harassment or illegal activity

  • Posting prohibited content

  • Chargebacks or payment abuse

Users may also request their account be deleted.

17. Service Changes

Shift It may modify or discontinue any part of the Service at any time, including features, pricing, or functionality.

18. Governing Law

These Terms are governed by:

  • Irish law

  • Applicable EU regulations, including GDPR

Any disputes must be resolved in the courts of Ireland.

19. Amendments

Shift It may update these Terms at any time. Continued use of the Service constitutes acceptance of updated Terms.
